Terms of purchase

Swedish version

Klaravik AB (556881-8693), hereinafter referred to as Klaravik, is an auction company that represents and acts as an agent primarily for companies, municipalities, finance companies, public authorities, and estates. Klaravik's role is to sell objects from these sellers (hereinafter referred to as “clients”) to the highest bidder (hereinafter referred to as “buyers”) through online auctions.

Auction 

All objects on klaravik.se are sold by auction. Bids can be placed 24 hours a day on the auctions being held. Each auction ends at the specified time, but is extended by approximately three minutes in the event that a new bid is placed within three minutes of the closing time.

Once the auction has ended, Klaravik will contact the bidder with the highest bid within two working days. Any invoice sent is considered equivalent to contact.

 

Sellers 

Sellers are the clients who have commissioned Klaravik to sell objects. Klaravik's clients consist primarily of companies, municipalities, financial firms, government agencies and estates.

It is always the client who sells and is responsible for the objects in the auction. Klaravik acts solely as an intermediary and is neither the owner nor the seller of the property. Responsibility for auctioned objects remains with the client. Nor does Klaravik assume the role of exporter when selling to foreign buyers.

 

Buyers 

A registered buyer account on klaravik.se is required to purchase objects through Klaravik. In order to place a bid, the buyer must accept Klaravik's terms and conditions of purchase and be at least 18 years of age. It may take a few hours, or in some cases longer, before a registration has been reviewed and approved.

Registering an account under a false name or someone else's name may result in a police report.

If Klaravik suspects that a buyer is misusing their buyer account, not complying with the terms and conditions of purchase or not following established agreements, Klaravik has the right to block the buyer from placing bids on klaravik.se.

 

Bidding 

All bids are binding and apply even if the bid has not reached the reserve price at the end of the auction. If the reserve price has not been reached, bids are binding for two working days after the auction closes. The buyer agrees to be available to Klaravik's employees during this period. The binding period for the bid shall be extended by two working days when a new bid has been submitted in negotiations.

In addition to manual bidding, it is possible to place automatic bids. The maximum bid for a specified automatic bid is not visible to other bidders. If two people place the same bid, the bid that was placed first will be given priority. When this happens, it is clearly visible in the bidding history.

Klaravik is not responsible for bids that are not registered.

Objects for sale 

Al lobjects on klaravik.se are sold as is. The auction documentation consists of text, images and, in some cases, video. Always review the auction documentation carefully. Please note that images may occasionally be misleading and inconsistent with reality, for example in terms of colour, shape and size.

Klaravik does not perform inspections objects. With the help of the client, Klaravik's brokers make an interview-based assessment of the object's condition.

If an object has a limited description of its condition, the buyer should bear in mind that there may be unknown or hidden defects.

Klaravik ensures that the objects sold are not encumbered by tax liabilities and that no other outstanding liabilities are transferred to the buyer.

When purchasing vehicles subject to registration, the seller and buyer are jointly responsible for completing the transfer of ownership title upon collection. In some cases, Klaravik handles the transfer of ownership between the parties, but solely in an intermediary and administrative role. Transfer of ownership of registered vehicles normally takes place within the first few days after collection. However, if the vehicle is subject to a credit or leasing restriction, the process may take longer, in some cases more than two weeks.

 

Repair objects and spare parts 

If an object is described as requiring repair in the auction documentation, it has not been fully inspected or test driven by the client or Klaravik. The object may be missing parts or have more defects than those described in the auction documentation, which should be taken into account when bidding. Passenger cars and light trucks with a sales price of less than SEK 30,000 are also considered repair objects.

If an object is described as being for spare parts in the auction documentation, it is in such poor condition that it cannot be used for its intended purpose, which should be taken into account when bidding.

Claims on repair objects and spare parts objects are not accepted.

 

Reserve price 

The reserve price is the lowest final price that the client has agreed to accept in advance. The auction page for the object will indicate whether the reserve price has been met or not.

A binding agreement has been entered into between the highest bidder and the seller at the conclusion of the auction, provided that the winning bid meets or exceeds the reserve price. In the event that the winning bid is lower than the reserve price for the object in question, the seller has the right to reject the bid, but may also choose to accept the bid and thereby enter into a binding agreement.

 

Warranty 

No warranty is given on purchased objects.

 

Fees 

There is a bidding fee on all objects sold on Klaravik. The bidding fee varies depending on the object and is clearly displayed on the object in question when the buyer is logged in to klaravik.se.

 

VAT 

All objects are subject to VAT unless otherwise specified. This is always shown for the object  in question.

 

Payment 

For a buyer with the highest bid in an auction, and where the reserve price has been reached, an invoice will be sent via email from PayEx. Invoices are payable within seven days. Payment shall be made with discharging effect for Klaravik AB.

Buyer's duty of inspection 

Buyers have a far-reaching duty to conduct inspection. This means that upon collection, the buyer must inspect and approve the condition of the object in relation to the auction documentation.

Physical viewings of objects  are not normally offered while an auction is in progress. Any exceptions are stated in the auction documentation.

All objects on Klaravik are sold as is. Defects and flaws may be present on the objects, as they are often used/second-hand objects.

The client is not responsible for errors that the buyer does not discover at the time of collection. If the buyer engages a freight forwarder or agent to collect the object, the object is considered accepted and approved when the object leaves the collection point. The client is also not responsible for any errors that arise after collection.

Neither the client nor Klaravik shall be liable for defects in objects or property sold on behalf of bankruptcy administrators or in other compulsory sales.

Collection 

Before the buyer can collect an object, the invoice must be registered as paid with Klaravik. Once payment has been registered, the buyer will receive a collection receipt with the client's contact details (the receipt will be sent by email). The buyer contacts the client and books a collection time that suits both parties. The client is not obliged to offer collection during evenings or weekends.

Unless otherwise specified, the buyer is responsible for collection, loading and any dismantling of the object.

Upon collection, the reference code on your collection receipt must match the client's delivery receipt. Note that both receipts have Klaravik as the sender and must be signed.

Buyers have twelve days to collect the object after the auction has ended. If an object has not been collected within twelve days of the auction closing, Klaravik reserves the right to charge a fee. The fee is SEK 500 (excl. VAT) per new week for objects with a bid below SEK 20,000 (excl. VAT) and SEK 1,000 (excl. VAT) per new week for objects with a bid above SEK 20,000 (excl. VAT).

If the client is unable to allow the buyer to collect the object within 12 days, the buyer is entitled to either demand fulfilment or cancel the purchase. The client is not obliged to fulfil the purchase if there is an insurmountable obstacle or if fulfilment would entail concessions that are unreasonable in relation to the buyer's interest in the client fulfilling the purchase. In the event of justified termination, the buyer is entitled to a refund of the amount paid to Klaravik. The buyer is always obliged to take reasonable measures to prevent, avoid or limit loss or damage.

The client accepts no responsibility for any deterioration in the condition of objects that are not collected on time.

For objects that have not been collected by the buyer or their representative within 30 working days (or another period specified in the auction documentation), the client is entitled, through Klaravik, to cancel the purchase and relist the object for sale.

The client and Klaravik are entitled to compensation for costs incurred as a result of the cancellation and for any other losses. If the sale price is insufficient to cover the client's and/or Klaravik's damages and costs for resale, the buyer shall compensate for the difference. If the object cannot be sold or if the price does not cover the costs of a sale, the client and Klaravik may scrap/recycle/dispose of the object. Prior to this, the buyer shall be notified using the last known contact details.

EU sales and exports 

Foreign buyers are obliged to export an object from Sweden to the country where the buyer is registered/resident immediately after collection.

Buyers from countries with a CPI (Corruption Perceptions Index) lower than 60 must undergo a more rigorous validation process than other buyers in order to obtain an approved buyer account on Klaravik.

When making purchases on Klaravik, VAT is always included on the invoice unless otherwise stated. It is important that you pay the full amount.

If the account is registered as a foreign company and has a valid VAT number, the buyer can request a VAT refund from Klaravik. To have the VAT credited and refunded, the buyer must send valid export documents to info@klaravik.se by no later than ten days after the month in which you picked up the object. Past this deadline, a refund of the VAT is not guaranteed.

For EU sales, Klaravik must have access to:

1) Signed CMR document or consignment note.
2) The invoice from the transport company.
3) Klaravik's export declaration, which the buyer receives in conjunction with collection of the object.
4) The IBAN and Swift numbers of the company in question. 

When exporting outside the EU, Klaravik must have access to:

1) Customs documents.
2) Klaravik's export declaration, which you receive in conjunction with collection of the object.
3) Your company's IBAN and Swift numbers.

 

Right of return 

Bidders (business operators) on Klaravik have no right of return when entering or winning a bid. All bids are binding.

The following applies to consumers shopping on Klaravik:

In accordance with the Swedish Act (2005:59) on Distance Contracts and Contracts Outside Business Premises, a 14-day right of return shall apply. The return period begins on the day the consumer takes possession of the object.

If the buyer wishes to invoke the right of return, they must return or send back the object without undue delay and no later than within 14 days. Before doing so, the buyer must contact Klaravik at info@klaravik.se for further instructions regarding returns. The buyer is responsible for the cost of returning the object after cancelling their purchase. Refunds will be made no later than 14 days after the buyer has contacted Klaravik and cancelled a purchase, but not before the object it has been received in return. A returned object must be in the same condition as when it was received. This means that it must not have been modified or repaired or have any damage that was not present when the buyer took possession of it.

If the buyer has handled the object to a greater extent than was necessary to determine its characteristics or function (maximum ten kilometres for vehicles or one hour for machines), the buyer is liable for compensation for the object's depreciated value. For passenger cars, depreciated value is estimated at SEK 50 (including VAT) per kilometre driven over 10 kilometres. For excavators, tractors, dumpers and wheel loaders weighing less than 5,000 kg, depreciation is calculated at SEK 800 (including VAT) per hour driven. For machines weighing over 5,000 kilograms, depreciation is calculated at SEK 1,200 (including VAT) per hour driven. For other machines and vehicles, depreciation is calculated based on the value of the machine, its age and the cost of renting a similar machine.

If the buyer exercises their right of return when purchasing a registered vehicle, ownership of the object will be transferred to Klaravik, or another party, upon receipt of the returned vehicle.

In order for Klaravik to complete the transfer of ownership and subsequent sale of the vehicle, the buyer must authorise Klaravik to transfer ownership to a new owner and handle the sale in the manner Klaravik deems appropriate. A power of attorney form is provided by Klaravik and must be signed by the buyer before the transfer of ownership can be completed.

Notification regarding cancellation of purchase should be sent to info@klaravik.se. The buyer can also use the standard form available on the Swedish Consumer Agency's website konsumentverket.se.

 

Claims 

If the buyer wishes to submit a claim regarding an object, they should contact Klaravik by telephone on 054-15 13 04, send an email to reklamation@klaravik.se or fill in the following the form

Klaravik acts solely as an agent and is therefore not a party to any claims. Klaravik can accept claims regarding liability for defects in objects sold. Klaravik can also mediate information between buyers and clients in order to reach an agreement. Klaravik is not the legal representative of the client.

Claims must be made before the buyer has transported the object away from the collection point specified by the client. If collection takes place outside Klaravik's opening hours and the buyer agrees with the seller on a claim, such agreement must be documented in writing. The note shall contain what has been agreed, any adjustment to the purchase price and the signatures of both parties. This serves as a confirmation of the settlement. The buyer should photograph, film or otherwise document the object on site at the time of collection in order to be able to substantiate remarks.

Klaravik and the client must always be notified before any repairs are carried out. Any cost estimates must always be approved by Klaravik and the client in advance. The buyer has no right to compensation if the repair is carried out before approval has been granted. In the event of a complaint, neither direct nor indirect losses are compensated by the client or Klaravik.

 

Technical and manual errors 

Klaravik accepts no liability for damage, loss or consequential damage that may be incurred by purchasers or clients as a result of technical faults, communication problems or similar. Klaravik is not responsible for failure to register bids or establish contact.

Klaravik reserves the right to correct printing and typing errors on its website and does not guarantee that images accurately represent the objects sold. Klaravik reserves the right to decline sales throughout the sales process, disregard bids and iterate a new bidding process in the event of technical problems, errors or other reasons. Klaravik accepts no responsibility for damage, consequential damage or costs that may be incurred by bidders or clients as a result of the above.

 

Processing of personal data 

Klaravik processes all personal data in accordance with the General Data Protection Regulation (GDPR). When a buyer registers a buyer account, they agree that Klaravik may use the relevant company's details in order to fulfil its obligations towards the purchasing customer.

Applicable law and disputes 

These terms and conditions of purchase shall be interpreted and applied in accordance with Swedish law. Any disputes concerning the interpretation and application of these terms and conditions of purchase and the provision of Klaravik's auction service shall be settled by a general court in Sweden in accordance with Swedish law. The Act (1987:822) on International Purchases shall not apply to Klaravik's services.
